The Independent Investigation Unit of Manitoba (IIU) has concluded its investigation into the injuries sustained by an adult male during his arrest by Brandon Police Service (BPS) officers.
On May 28, 2023, BPS notified the IIU of the following incident. According to the notification, on May 27, 2023, at approximately 2:25pm, BPS officers were dispatched to a domestic disturbance call. After investigating the incident, officers conducted a compliance check of the residence under the authority of an existing court order. The two occupants became obstructive and were arrested. An adult male was uncooperative while police were handcuffing him. As officers escorted him from the residence, the male managed to break free and attempted to flee. A use-of-force encounter ensued, during which the male sustained a broken tooth. He was taken to Brandon Regional Health Centre for medical clearance and then lodged in custody.
The IIU assumed responsibility for the investigation in accordance with Sec. 75(1) of the Police Services Act. IIU investigators were assigned to this investigation. One subject officer and three witness officers were designated. Investigators interviewed one civilian witness in relation to the incident. The IIU investigative file was sent to Manitoba Prosecution Service for a Crown opinion in relation to possible criminal charges.
Following due consideration of all the circumstances, including the Crown opinion that the standard for prosecuting charges has not been met, the civilian director will not be authorizing charges. Therefore, the IIU investigation is completed, and the matter is now closed.
As an affected person remains before the court on charges arising from the incident, the civilian director’s report on the incident will not be made available until those charges are disposed.
